Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to acid from the multi-media filter tank when the tank failed: a)APU Waste Treatment Room: The ECO-TEC Multi-Media Filter Tank was replaced with a plastic tank which was not designed and fabricated to manufacturer specifications, and an employee was sprayed with nitric and hydrofluoric acid when the tank ruptured, on or about 10/06/99. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the ECO-TEC operating manual and replace the tank with a multi-media tank designed by ECO-TEC to APU system specifications.
