Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to silica dust in excess of the Permissible Exposure Limit (PEL): a)241 Main Street, Hackensack, NJ: The PEL's for the construction and maritime trades are expressed in millions of particles per cubic foot (mppcf), and exposure levels have been determined using the impinger sampling method. The PEL for general industry is expressed in both mppcf and in milligrams per cubic meter (mg/m3). The impinger method of sampling and counting dust particles is obsolete and, to OSHA's knowledge, is not used anywhere in this country to assess worker exposure to silica-containing dust. OSHA's sampling was conducted and has been determined that two GAR Waterproofing employees were exposed to 1.4 and 1.8 mg/m3 of dust, respectively, while chipping out brick and mortar during brick replacement operations on or about 11/16/99. This level is indicative of exposures in excess of the construction PEL of 47.9 and 48.5 mppcf, respectively.
