Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a fall from an elevation in excess of 12 feet as employees worked from a makeshift platform that was supported between two scissor lifts: a)Jobsite, 250 Oak Ridge Rd: Employees were working on a makeshift platform that was supported between a Barecat Economy BC2132 scissor lift and a Skyjack B241F scissor lift. Employees were exposed to the hazards of a fall from an elevation in excess of 12 feet, on or about 8/2/2000. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to utilize a lift that is capable of reaching the required working height and is approved for the purpose by the lift manufacturer.
