Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries where unstable loads were not secured to forklifts: a)Trailer Yard: On August 8, 2000, a 50 foot long steel I-beam was being lifted on the forks of a TCM forklift truck and was not secured to the forks. The I- beam toppled off the forks and onto an employee resulting in a leg amputation and a broken arm. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the manufacturer's operation and maintenance manual which recommends when taking into account the shape and material of loads to be handled, use a proper attachment and tools.ment
