Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: Construction Site:Kennedy Street, New Square, N.Y. 10952 on or about 2/23/00 a) an employee was observed being lifted by the chain connected to the bucket of the Deere 450 LC backhoe. The employee was being lifted into the concrete manhole. ONE FEASIBLE AND USEFUL MEANS OF ABATEMENT, AMONG OTHER METHODS, WOULD BE TO INSTRUCT EMPLOYEES NOT TO RIDE ANY PORTION OF MOVING HEAVY EQUIPMENT, EXCEPT FOR DESIGNATED OPERATING SEATING.G
