Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: a crushing hazard
LOCATION:  25 7th Street
Pelham, NY
The Yard
a) on or about 4/28/00, 25  7th Street Pelham, New York
employees were preparing to unload brick from the 8' 3500 series dump
truck. One employee
released the lever to open the lower portion of the tailgate, while the
other began releasing the
safety pins from the top portion. There was ONLY one chain on the
tailgate. Therefore, when
the upper and lower portions of the tailgate were opened, it became a
PIVOT
POINT for the
tailgate; swaying to one side and partially amputating the employees left
thumb.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS AT A MINIMUM THE FOLLOWING:
1) Develop and Implement a program to periodically monitor employees work
to ensure the
proper use of equipment and adherence to safe work practices in accordance
with the
manufacturers recommendations
2) Develop and Implement a program to inspect vehicles and ensure all
parts are in good
working order prior to use
3) Obtain nanufacturers safety and operations manuals for the vehicle and
place warning placards
on the equipments as required
NOTE: The employer is required to submit abatement certification for this
item in accordance
with 29 CFR 1903.19.ce
