Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards or were
causing or likely to cause death
or serious physical harm to employees that were expose to the hazard of
falling from an elevated location
while operating the lifting equipment without  emergency stops in place
prior to operation and not performing
daily inspections as required:
Location:     North Side of 105 De Vries Court Piermont, New York
ON OR ABOUT:   05/17/2001- Accident on 05/15/2001
Employee(s) were exposed to the hazard of falling from an elevated
location while operating a Boom Lift (
1997 JLG # 049456 03000 30273)  from heights greater than 6 feet,
(operation of lift was at the 4th and 5th
floors of 105 De Vries Court) . Employees were not able to control the
descending lift, due to an Emergency
Stop Button was not provided at the control panel nor was the Boom Lift
inspected prior to the operation of
the equipment.
AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT TO CORRECT THIS
HAZARD IS TO:
(1)  Prohibit employees from using equipment until a Daily Inspection is
done and prohibit employees from
using equipment that does not provide an emergency stop button.
(2)  Follow the  JLG manufactures Operator's & Safety  Manual,
section 6 on Emergency Procedures, which is provided on all machines.
(3) Follow the  ANSI/SIA A92.5-1992 Manual of Responsibilities safety
manual section 8.3 to 8.6 provides,
Pre-start Inspection information, before use each day or before each shift.
NOTE: Because abatement of this violation is already documented in the
inspection case file, the
employer need not submit certification or documentation of abatement of
this violation as normally
required by 29 CFR 1903.19.
