Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads and/or falling hoist parts: (a) Fabrication/Weld Shop: The 5 ton Yale hoist had the following deficiencies: (1) The stop button on the pendant control was not operational. (2) The latch on the hook was not operational. (3) Preventative maintenance inspections were not completed in accordance with the manufacture instructions on a monthly or periodic basis. (b) Fabrication/Weld Shop: The 5 ton Load Lifter Hoist had the following deficiencies: (1) The stop button on the pendant control was not operational. (2) Preventative maintenance inspections were not completed in accordance with the manufactures instructions on a monthly or periodic basis.
