Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads and/or falling hoist parts: (a) Wool Building; The following deficiencies were noted for the Shepard Miles hoist in the Wool Building: (1) There are no periodic, documented inspections of the hoist; (2) Employees work partially under a suspended load (the burner); (3) The company does not know the weight of the burner lifted by the hoist; (4) The rated load was not permanently marked on the hoist; (5) The pendant control buttons were not marked. (b) Back Room, Third Bay; The following deficiencies were noted for the Lodestar hoist in the Third Bay: (1) There are no periodic, documented inspections of the hoist. Among other methods, one feasible and acceptable abatement method to correct these hazards is to develop a preventative maintenance program which incorporates all recommendations outlined in the manufacturer's manuals with written, signed and dated reports. These reports should also be in accordance with ANSI B30.16 in order to ensure a safe and properly functioning hoist.
