North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to a crushing hazard:
A latch was not provided to bridge the throat opening of the hook
for he purpose of retaining slings, chains, etc., under slack
conditions (ref. ANSI B30.16-1981 Sec 16-1.2.9):
Frequent visual examinations of all functional operating mechanisms
for misadjustment interfering with proper operation, deformed,
chemically damaged, or cracked hooks, hook latches, and hoist load
chain by the operator or other designated personnel, with records
not required, were not performed on a monthly basis for hoist used
under normal service (ref. ANSI B30.16-1981 Sec 16-2.1.2):
a)Primary area, line 1 and line 3 final side - two, 2-ton,
CM Loadstar, electric chain hoists, used for lifting 988
lb. catapullers and 1,308 lb. rafts.
One feasible and acceptable method of abatement,
among others, to correct this hazard is to have a
certified crane company to install safety latches
on the appropriate hooks; have designated and
qualified person to perform frequent inspections of
the hoists to ensure compliance with applicable
provisions of this standard.
