North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling and/or shifting machinery that was being worked on while other employees were supporting the equipment with fork lift trucks, which resulted in the death of an employee who was crushed by falling equipment. AMONG OTHER METHODS ONE FEASIBLE MEANS OF ABATEMENT WOULD BE TO SECURE THE BELL FELLER BUNCHER TO THE FORK LIFT TRUCKS SO THAT IT WOULD NOT FALL OFF OF ITS BLOCKS WHILE BEING WORKED ON. REFERENCE: CONSTRUCTION STANDARDS 1926.600(a)(3)(i) a)facility, east side exterior - Bell Feller Buncher was not secured to prevent shifting while employees supported the buncher with a fork lift truck.r
