North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: 1)Employer Mr. Daniel, Phillip, and Harold Morton failed to provide to each of his employees a place of employment wherein employees were not exposed to live electrical parts. At Mr. Morton's temporary labor camp workers were exposed daily to live electrical parts on the exterior as an outlet plate was not installed and in the kitchen as refrigerators are not properly provided with an adequate path to ground as electricity is provided through use of extension cords. One acceptable and reasonable method of abatement is to plug refrigerators and other appliances directly into electrical outlets and install outlet plate on exterior electrical outlet as discussed.
