North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to caught in/under and between hazards: a)rail load out station - employer allowed employees to "foul a track" when other methods were available to couple rail cars (reference 49 CFR 214.315(b). One feasible method of abatement is to maintain positive control mechanism to hold and control the movement the rail car throughout the entire operation.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to caught in/under and between hazards: a)rail load out station - employer failed to develop, implement, maintain and train employees on the correct procedures for accessing a moving hopper cars (Reference 49 CFR 214.315(a)) One feasible method of abatement is to develop written procedures for safely accessing a moving hopper car.
