29 CFR 1910.252(a)(vi)(c): Cutting or welding was permitted in the
presence of explosive
atmospheres (mixtures of flammable gases, vapors, liquids, or dusts with
air):
a)Roanoke Rapids Sanitary District, top of digester #3- where an
employee used a Victor oxyacetylene cutting torch to cut off bolts
near a pipe vent with a 3 inch threaded cap that was leaking
methane.
Or, in the alternative:
North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish each of his employees conditions
of employment and
a place of employment free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees in that employees were exposed to:
hazards associated
with fire, including but not limited to second and third degree skin burns.

One feasible acceptable abatement method to correct this hazard is to use
a different method to
