North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls of up to 25' (ref para 8.25.1(f), 8.25.1(g), 8.25.1(h), 8.25.1(l), ASME B56.6-1992): a)site-employee of Labor Finders temporary employment agency, working on a locally manufactured platform without load markings, loosely attached to the forks of a Keohnig Skytrak rough terrain forklift with a lightweight galvanized steel chain with 1" long links, routed behind the fork attachment of the lift and attached to the 1/2" plywood of the side of the box with eye-bolts, with no method to prevent the box from rotating on the forks 25' above the ground, with one side open, and was not provided with fall protection. One feasible method of abatement is to provide for an authorized personnel basket properly attached, load tested, and marked.
