North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (Reference American National Standard (ANSI) B30.5-1968/1995, sections 5-3.1.2, 5-3.1.3, paragraph d. a)Job site - The employer did not ensure that the operator of Grove truck crane model TMS 475 LP, serial number 34577 was qualified or properly trained as stipulated by ANSI standard. (ANSI B30.5, section 5-3.1.2, 1968/1995) b)Job site - The employer did not ensure that the operator of Grove truck crane model TMS 475 LP, serial number 34577 was aware of his responsibilities and authority to stop or refuse to handle loads until safety has been assured. (ANSI B30.5, section 5-3.1.3, paragraph d, 1968/1995) Among other methods, two feasible and acceptable abatement methods to correct this hazard would be to enroll the operator in a formal school certified by an approving educational authority or a factory school provided by the crane manufacturer.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (Reference American National Standard (ANSI) B30.5-1968/1995, sections 5-3.2.1.4, paragraph h.) a)job site - The employer did not ensure that the operator of Grove truck crane model TMS 475 LP, serial number 34577 fully extended the outriggers prior to initiating the lift. (ANSI B30.5, section 5-3.2.1.4, paragraph h, 1995) Among other methods, two feasible and acceptable abatement methods to correct this hazard would be to enroll the operator in a formal school certified by an approving educational authority or a factory school provided by the crane manufacturer and to ensure adherence to all operating requirements.
