North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
(Reference American National Standard (ANSI) B30.5-1968/1995,
sections 5-3.2.1.4, paragraph c.2; 5-3.4.5, paragraph c., and 5-
3.4.5.4, paragraphs a and c.)
a)Job site - The employer acting as "the individual
directing the lift", did not ensure that the operator of
Grove truck crane model TMS 475 LP, serial number 34577
maintained clearance from obstructions as stipulated by
ANSI standard. (ANSI B30.5, section 5-3.2.1.4, paragraph
c.2, 1968/1995)
b)Job site - The employer did not ensure that before
commencement of operations near electrical lines, the
person responsible for the job notified the owners of the
lines or their authorized representative pertinent
information or request for cooperation. (ANSI B30.5,
section 5-3.4.5, paragraph c, 1968/1995)
c)Job site - The employer did not ensure prior to
operations that a qualified person together with a
qualified representative of the utility/engineer, visited
the site and determined the most feasible way to complete
the operation or set minimum clearances; nor did he
designate a qualified signal person, whose soul
responsibility would be to verify clearances are
maintained. (ANSI B30.5, section 5-3.4.5.4, paragraphs a
and c, 1995)
Among other methods, one feasible and acceptable
abatement methods to correct this hazard would be to
review ANSI standards and establish procedures that
ensure responsibilities are identified early in the
