North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees, in that an employee was elevated approximately 13' above
the ground in a fabricated personnel platform attached to the forks
of a rough terrain fork lift, without the information available to
determine if the platform was constructed according to applicable
safety standards or if the fork lift was being operated according
to applicable safety standards Reference ANSI/ASME B56.6-1992,
Section 5.15 and 8.25!:
a)trim saw facility addition:  an employee was elevated
approximately 13' above the ground in a fabricated
personnel platform attached to the forks of a rough
terrain fork lift.  The site foreman did not have the
information available to determine if the platform was
constructed according to applicable safety standards or
if the fork lift was being operated according to
applicable safety standards.
