North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to an explosion hazard and extreme fire,
heat, and smoke:
Mechanical or local exhaust ventilation was not provided to prevent
the accumulation of explosive vapors (ref. MSDS, C1010 Concrete
Primer) which resulted in death of one employee and serious injury
to another employee with burns over 20of his body:
a)gymnasium - three employees applying C1010 Concrete
Primer; 25 degree F. flash point; 1.0 LEL; vapor
density heavier than air; 18 to 100 feet from two Vulcan
gas stoves with 12 lit pilot lights, at a room
temperature between 72 and 75 degrees F.
One feasible and acceptable abatement method, among
others, to correct this hazard is to provide some type of
mechanical ventilating equipment to keep explosive vapors
below the LEL.
