North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)warehouse, a safety platform was not provided to protect
employees being lifted with the forklift truck;
employees were lifted on a 2.5' x 5' wood crate to reach
glass windshields on the third and top shelves of the
pallet rack storage system.
One feasible and acceptable abatement method to correct
this hazard is to provide equipment designed for safe
lifting of personnel such as but not limited to a high
lift order picker rider truck.
