North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) facility -- holes in the floor of work areas, cracks in the floor of work areas and aisles, and broken or missing tile in the aisles created fall hazards for the blind employees in the facility. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair the holes and cracks in the floor and replace the broken and missing tile."g
