Section 5(a)(1) of the Occupational Safety and Helath Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being crushed while performing
grain railcar
spotting operations on January 13, 2000 and times prior thereto.  Among
other methods one
feasible and acceptable abatement method to correct this hazard is:  1)
Implement the
guidelines as set out in the 9TM Trackmobile operator manual for the use
of the Trackmobile
air brake system during the spotting of cars; 2) Prohibit employees from
riding on the
railcars; 3) Assure rail cars are coupled before moving.
