Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that the employees were exposed to the hazards of falling or being crushed; (a) Scum Pump Excavation, Helena Wastewater Treatment Plant; On or about March 31, 2000 and at times prior thereto, employees were allowed to ride in the backhoe bucket for access and egress from the excavation. Among other methods, feasible and acceptable methods to correct the hazard would be to create a work rule and communicate the rule to the employees to not ride in the bucket of a backhoe, loader or other equipment that is not approved for such use and to provide an approved method of access and egress from excavations such as a ladder. __ Abatement certification or documentation is NOT required for this item. __ Abatement certification is required for this item. x_ Abatement certification and documentation are required for this item. __ Warning tag (or citation copy) required on this equipment before moving.
