March 31,
2000 and at times prior thereto, employees were allowed to ride in the
backhoe bucket for
access and egress from the excavation.
Among other methods, feasible and acceptable methods to correct the hazard
would be to
create a work rule and communicate the rule to the employees to not ride
in the bucket of a
backhoe, loader or other equipment that is not approved for such use  and
to provide an
approved method of access and egress from excavations such as a ladder.
