Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of falling approximately 10 feet and being crushed by an unsecured, unguarded wooden platform that had been raised in place by the forks of a JCB loadall forklift on or about May 2, 2000 and at times prior thereto at the Twin Hills Colony located 50 miles north of Great Falls, Montana. Among other methods, one feasible and acceptable abatement method to correct this hazard is to design and build a safety platform and secure it to the forklift as stated in ANSI B56.6- 1991. __ Abatement certification or documentation is NOT required for this item. __ Abatement certification is required for this item. X_ Abatement certification and documentation are required for this item. __ Warning tag (or citation copy) required on this equipment before moving.
