North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite, at structure; employees working on an elevated work platform supported by a motorized forklift without the platform being secured to the forks of forklift to prevent movement or falling, resulting in a 10' fall. b)jobsite, at structure; employees working from an elevated work platform supported by a motorized forklift, without guardrails on one open side, exposing employees to 10' fall hazard. c)jobsite, at structure; employee/operator did not follow owner/operator instructions and safety messages by using the machinery for lifting personnel, resulting in a 10' fall.ting
