North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite, employees operating/moving a Mobile Elevating Work Platform, did not follow operator/user manual instructions by not assuring adequate clearance of overhead hazards/obstructions. b)jobsite, employees operating/moving a Mobile Elevating Work Platform, did not follow requirements of ANSI/SIA A92.6-1990 for Self-Propelled Elevating Work Platforms, by not following instructions and requirements of Operators/Users Manual, and by not assuring adequate clearance of overhead hazards/obstructions.
