Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by nails or other similar fastening devices installed with pneumatic nail guns. One method among other feasible methods of abatement would be to ensure that the operator of the nail gun check the work area prior to activation of the tool and that all workers not using the nail gun, be instructed to stand clear of the operation and not enter that location until notified by the operator. Jobsite: 49 South Street, Marion, MA 02738: On December 28, 1999, an employee was seriously injured when the operator he was struck in the head with a nail from a Bostitch air powered nail gun, Model # N63CP, while installalling wood trim on the exterior of the deck.ior
