Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to: The hazard of being struck by boxes of snap-ties or the individual pieces that were not secured to a wooden pallet while being hoisted from the ground to the 17th floor. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to hoist this load in a bucket/scale pan. Location: North tower. Employees were exposed to serious injury of being struck by cardboard boxes of snap ties that were not firmly secured to the pallet to prevent them from falling out while being hoisted to the 17th floor.d
