Section 5(a)(1) of the Occupational Safety & Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, employees were
exposed to being struck by or caught in between the swinging
superstructure of Caterpillar 350L
crawler excavator:
Job Site Southwest side of site.
1) Employees were walking in close proximity to the working excavator to
travel to and
from the site General Contractor and sub-contractor trailers.
2) The excavator was working within close proximity to the bank of job
site portable
toilets.
3) The excavator was working in close proximity to a site access gate.
One feasible method of abating this hazard is to construct a barrier
around
the excavator
work area to prevent employees from entering the danger zone. In
conjunction with this
method, appropriate training must be administered to all individuals on
the site informing
them of this danger zone of the working excavator.
