OSHA opens inspections for many reasons — routine scheduling under a national or local emphasis program, an employee complaint or referral, or a follow-up after a reported injury. Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that, employees were
exposed to being struck by a falling 55 gallon drum of diesel fuel which
was unsecured on a
platform:
Job Site: Near site trailer.
A fifty-five gallon drum of diesel fuel was laying on its side on top of a
single tier of a
tubular welded frame platform that was not level, had no base plates, and
was missing
a cross brace. The rocks placed on either side of the drum to prevent it
from rolling were
inadequate.
One method of abatement, among others, for this situation would be to
upright the drum
and place it on the ground and install a mechanical pump.nical
