Section 5(a)(1) of the occupational safety and health act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:  being struck by vehicular traffic while walking throughout
the jobsite, working and
accessing their work zones.  Among other methods, one feasible and
acceptable method to
correct this hazard is to ensure that the traffic management plans and
general notes, specifically
drawing C-555, C-561, C-550 and the referenced Manual on Uniform Traffic
Control Devices
(MUTCD) and the Massachusetts Highway Department (MHD) standard
specifications are
adhered to.
Location:Central Artery Contract C09A7, Dorchester Avenue.
The following is a list of feasible abatement methods including but not
limited to traffic control
devices and access to work areas:
a) Maintain temporary barriers along the east side of USPS roadway to
provide protection for
employees from vehicular traffic.
b) Equip temporary barriers with Type A and C warning lights.
c) Install Type III Portable breakaway barriers with R5-10c signs at two
specified locations, west
side south bound and east side north bound on Dorchester Ave.
d) At the wheel wash location, install type A Flashers on the concrete
barriers and remove the
fencing and sign attached to the top of the barrier.
e) Install the lane widths at the "S" curve at 16 feet wide per drawing
C-561.
f) Maintain the road markings properly so that they are visible.
g) Provide safe access at the north end of the sidewalk on east side of
Dorchester Avenue to the
trailer and staging area so that employees are not diverted into traffic.
h) Alter the existing access provided on the east end of the trailers so
it does not lead employees
to either walk over the wheel wash or walk in the street along the jersey
barriers which exposed
them to being struck by vehicular traffic while coming or going to their
work zones.
i) Pin the jersey barriers together to minimize displacement.
