Section 5(a)(1) of the occupational safety and health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by rigging gear. Location: Central Artery Project C01A6 (night shift) Employees were exposed to serious injury when they (1) unexpectedly encountered difficulty in obtaining release of a concrete form from cured concrete; (2) unilaterally varied from the employer's rigging instruction; (3) unilaterally bolted the rigging gear to an unapproved rather than the approved anchor point; and/or (4) failed to use washers to prevent the bolts from being pulled through the form when force was applied to the rigging.
