Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklift trucks without wearing the seat belt exposing them to potential crushing injuries. YARD & SHOPS: On or about an August 31, 2000 an employee was operating a Yale propane powered industrial forklift without using the available seatbelt.
