Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of working in a 28 inch diameter bore casing below ground, where an incapacitated or injured worker could not be rescued from inside: Employees were working at the far end of a fifty-six foot long, twenty-eight inch diameter bore casing using a hammer drill and no method was in place for an emergency rescue/retrieval. One feasible abatement method, among others, would be to designate a trained rescue team that was proficient and equipped to provide emergency rescue services with a body harness and tether for retrieval.
