Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with working around heavy equipment: Job Site: Addition Foundation Excavation. On September 28, 2000, employees, who were not kept away form digging equipment in use and were in an excavation while equipment was operated, were exposed to crushing and struck by hazards when the equipment, which was not properly parked, rolled into the excavation where the grade was pitched toward the excavation.
