employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to being struck by drill steel and other falling parts from the
drill rig that was modified
by the owner.

On or about October 6, 2000 the modification to the components of drill
rig Model TWM 20
Serial # MX-048 caused an accident where the stop did not prevent the
carriage from riding off
the top of the mast that resulted in falling drill steel and other
components.
Among other methods, one feasible and acceptable method to correct this
hazard would be to
have a qualified person, such as a professional engineer, design the
components,with specific
written instructions and specifications to be followed during the
manufacturing process, that
would include quality control and testing.
