Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to being struck by the A-frame hoist or its hoisted materials where the unit was not positioned on a level surface: Job Site: Roof - Terminal C. Employees were exposed to being struck by the Garlock A-frame hoist and/or its hoisted materials where it was not mounted on a level surface as specified in the operator's manual. One method of abatement would be to fashion a level platform where the base conforms to the curvature of the roof.ture
