North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling into a baler chute, and being crushed by the machine: a)plant, employees not adequately trained as qualified operators of the Selgo Baler as recommend by the manufacturer and American National Standard Institute (ANSI Z245.5-1982), Safety Requirements for Baling Equipment, and employer did not ensure that each operator was adequately trained to protect themselves from hazards arising out of the operation of a cardboard box compactor. Among other methods, a feasible and acceptable abatement method to correct this hazard would be to train operators assigned to this machine to follow the manufacturer's and ANSI requirements as outlined in the manual.
