29 North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to: a)establishment-rental Raymond swing-reach truck lacked a guard to protect operator against cases of yarn and pallet from falling onto chest area, in warehouse. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a guard to protect operator from cases of yarn and pallet from falling onto chest area."
