North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employement and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by equipment: a)Construction site, 8611 Cedar Hollow Road- Employee operating a Leeboy Model 300 pavement roller/compactor in close proximity to unguarded 35 degree sloped embankment without being provided protection against rollover of equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide pavement roller/compacter with a rollover protection structure, seatbelts and enforced use of seatbelts.
