North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)work site, near a trench under excavation--a 490D John Deere track hoe was being operated on the work site without a barricade being in place in such a manner as to prevent an employee from being struck or crushed. Reference:1926.550(a)(9): Accessible areas within the swing radius of the rear of the rotating superstructure of the crane, either permanently or temporarily mounted, shall be barricaded in such a manner as to prevent an employee from being struck or crushed by the crane.d
