North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility; Mixing area - Budgit 2 ton hoist was improperly installed. REFERENCE: ANSI B30.16 - 1981; 16-1.3.1 Procedures for installation recommended in the manual should be followed. NOTE: One feasible and acceptable method of abatement is to have the hoist properly installed.

REFERENCE: ANSI B30.16 - 1981; 16-2.1.1 Prior to initial use, all new, altered, or modified hoists shall be inspected...paragraph (b) on a frequent and periodic basis. NOTE: One feasible and acceptable method of abatement is to have the hoist inspected on frequent and periodic basis.ic
