Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by hydraulic cylinders exceeding 20 lbs falling from a conveyor which crossed over an employee walkway: a)Assembly area, adjacent to paint spray booth - On or about 11/17/99, the employer did not provide a guard to prevent employees from being exposed to injury as a result of being struck by falling hydraulic cylinders from a conveyor used to carry the parts through the paint spray booth. The conveyor crossed over an employee walkway. Parts can fall from the conveyor as a result of hooks used to hang parts, weighing approximately 20 to 30 lbs, becoming bent. Where overhead conveyors are used and if material may fall off the conveyor and endanger personnel, spill guards, pan guards, or equivalent shall be provided in accordance with paragraph 5.9.2 American Society of Mechanical Engineers (ASME) Publication B20.1-1993. Among other methods, several feasible and acceptable abatement methods to correct these hazards include: (1) Relocation of the walkway which passes under the conveyor to eliminate employee exposure to falling hydraulic cylinders; (2) Place a guard or other equivalent means under the conveyor to prevent falling hydraulic cylinders contacting employees on the walkway beneath the conveyor. NO ABATEMENT CERTIFICATION REQUIREDATION
