Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: a) Community Coffee, 1833 LA Hwy 1, Port Allen, LA. in the Roasting Department, on September 28, 1999, employee(s) were using a Toyota Forklift, #5EBE15, type 'E', to lift a "Supersack" of coffee beans which exposed employees to crushing injuries while operating forklifts without the use of a seat belt. One feasible and acceptable abatement method to correct this hazard is to issue a policy requiring the wearing of seat belts and enforce the wearing thereof.
