Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of head and/or torso entrapment between the truck and ground in the event of tipover due to employees not wearing seat belts while operating Hyster Fork-Lift industrial trucks. a) Among other methods, one feasible and acceptable method to abate this hazard is to ensure that employees utilize the seat belts in accordance with ASME B.56.1-1993 Section 5.3.19 while operating the industrial trucks, which are provided on the trucks by Hyster, the manufacturer. DISCLAIMERS: 1. The abatement method described above is general and may not be effective and/or apply in all cases. 2 General Motors is not limited to the abatement method suggested above. 3. The employer is responsible for selecting and carrying out an appropriate abatement method.nt
