North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)on ready-mix concrete plant site; Truck #001 and 3 other ready-mix trucks with audible back-up alarms not operating, and no personnel provided to direct backing truck traffic. Among other methods to correct this hazard is to assure back- up alarms are provided, repaired, or replaced, and functioning; assuring items on Daily Inspection Logs are properly inspected, proper documentation entered, and interpreted the same by all employees; assure supervisors/management review and follow-up in truck inspections and assure back-up alarm are functioning; and use personnel to direct backing vehicle to assure no pedestrian or other traffic is in path of truck; minimize number of trucks traveling and loading on this plant site, and re-route truck traffic to minimize backing up of trucks.
