Title 40.1-51.1.(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) 110' fall hazard. At 7:10 AM on 02/25/02 on the north side of 12601 Fair Lakes Circle, Fairfax, Virginia, the employer was having an employee use a Sky Genie brand lowering device in lieu of a boatswains' chair to power wash the building which resulted in an employee falling 110' feet and breaking his leg. Lowering devices are classified as prohibited equipment under paragraph 11.3 of ASME/ANSI A39.1a-1987, Safety Requirements For Window Cleaning. "One feasible and acceptable abatement method, among others, to correct this hazard is to use an approved boatswains' chair or suspension scaffold to power wash the side of the building."
