Title 40.1-51.1(A), Code of Virginia: The employer did not furnish
employment and a place of employment which was free from recognized
hazards that were likely to cause death or serious physical harm to
employees in that: (a) The driver of a GMC Flatbed Truck loaded
with pipe did not park the truck on level ground and did not stay
away from behind the load while it was being unloaded resulting in
the driver being injured when the load shifted and he was struck by
the pipe.
One feasible and acceptable abatement method among others to
correct this hazard is to adhere to the warning label placed with
the load stating to never stand behind or around load and the
trailer must be level before bands are cut and pipe are unloaded.
