40.1-51.1.(a):  The employer did not furnish employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the employer did not prohibit employees from
riding the attachment or load on a hydraulic excavator.
At the site job site, on the corner of Preston & Harris in
Charlottesville, Virginia, Jones & Frank Corporation's site
supervisor stepped into the bucket of a Caterpillar trackhoe which
transported and elevated him onto a 10,000 gallon fuel tank to
attach the crane spreaders.

Hydraulic Excavator User's Safety Manual; page 17  "Never allow
anyone to ride the attachment or the load. This is an extremely
dangerous practice."
"One feasible and acceptable abatement method, among others, to
correct this hazard is to ensure employee(s) do not use the
caterpillar bucket as a man-lift".
