Title 40.1 - 51.1.(a), Code of Virginia: Delta Star failed to furnish
employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in
that:
(a) The Delta radial arm saw located in the shipping/receiving department
was not guarded against side contact. The
saw also extended past the edge of the table and did not return gently to
its starting position. Reference:
1910.213(h).
"One feasible and acceptable abatement method to correct this hazard would
be to install a guard which would
automatically adjust to the thickness of the stock being cut and protect
against side contact with the blade, install a
return device on the saw, and extend the table so the saw would not extend
past the edge of the table."
